These General Conditions shall apply to all sales of products offered through the website www.navite.es (hereinafter “Products”), and together with the offer, price and description of the same set through the website, and, where appropriate, the particular conditions of the same contained herein (particular conditions), shall govern the legal relationship between Navité and the CUSTOMER, making up the entire agreement between Navité and the CUSTOMER.
The period of validity of these General Conditions of Contract shall be the time they remain published on the website, and shall refer to the purchase of Products at the time these conditions were available.
The acceptance of the present General Conditions of Contracting on the part of the CLIENT will be indispensable requirement in order to formalize any contractual relation between the CLIENT and Navité.
We are sorry, but we can only accept orders placed by persons of legal age. If you are a minor, you must inform your parents or guardians about these General Conditions of Purchase. It is your parents or guardians who must express their acceptance of them before using this website or making any purchase on it.
2. IDENTIFICATION OF THE PARTIES
On the one hand, Navité, enabler of the web portal www.navite.es, commercial name used by Núria Rubianes Cores, with fiscal address in Anglès Street 14, 17412 Maçanet de la Selva, NIF: 35462672F.
On the other hand, the CLIENT, of legal age, whose data are those that have been entered by him/her in the corresponding forms. All data included in these forms have been entered directly by the CLIENT, so the responsibility for the authenticity of the same corresponds directly and exclusively to the CLIENT.
3. OBJECT OF THE CONTRACT
Through the acceptance of these general conditions, Navité is obliged to make available to the CUSTOMER the Products purchased through the website www.navite.es and the CUSTOMER is obliged to pay the price indicated at the time of purchase.
4. REGISTRATION PROCESS
For the acquisition of the Products offered by Navité through its website, www.navite.es, it is not necessary to register. However, if the CUSTOMER wishes, he/she can register at any time before starting the purchase process, or, if applicable, during the purchase process.
In connection with the registration process, the CLIENT is solely responsible for the quality of the data entered by him/her in the forms, and accepts the obligation to provide truthful, accurate and complete data about his/her identity, as requested in the registration, purchase and accreditation forms, as well as to update all registration data so that they remain truthful, accurate and complete.
The CLIENT may at any time modify and/or update their data by accessing their User profile within the portal, but we recommend that you always confirm that the data entered and/or modified are correct, especially your email address and delivery address of orders, to avoid future inconveniences.
In order to register you must be of legal age according to Spanish law, and you may be a resident of any country in the world.
Once the CLIENT has entered his/her data and clicked on the registration button, we will send him/her a confirmation e-mail in order to authenticate the data provided during registration. The sending and receipt of such e-mail is usually automatic and in any case within 24 hours of sending the registration request. If the CUSTOMER has not received them in that period of time, it may be due to a punctual failure of communications or an error in the e-mail address provided by the CUSTOMER. If the CUSTOMER provides any false, inaccurate or incomplete information, or if NAVITÉ has enough reasons to suspect that such information is false, inaccurate or incomplete, NAVITÉ shall have the right to deny the access and present or future use of the web, or of any of the services.

6. PRODUCTS
All the information of the Products offered by Navité, by way of example, but not limited to, prices, characteristics, description, size, content, etc., are available to the CUSTOMER on the website and will appear on screen in each case.
We try that the descriptions and representations of the products that the CLIENT can visualize next to each one of them are as accurate and useful as possible. However, the labeling, packaging, size and colors displayed by the CUSTOMER on its screen may vary from the original product.
The photographs and data included in each product sheet are for information purposes only, therefore Navité declines any responsibility for the appearance of errors in such information.
7. PRICES
The characteristics and prices of the Products are indicated on the screen in Euros and include VAT and any other applicable taxes and shall at all times be those in force, except for typographical errors. Such taxes will be included in the invoice in an itemized form.
The prices shown on the website override all previously published prices and are in effect at the time of publication. Navité undertakes to make every effort to maintain these prices, but reserves the right to modify them without prior notice, informing the customer at the time of placing an order. Price changes will not affect orders already placed.
8. PURCHASING SYSTEM
In general, in order to purchase the products offered through the website www.navite.es, it is not necessary to be registered on the website, but it is necessary to accept the legal notice, purchase conditions and the corresponding privacy policy.
Remember that personal data must be indicated accurately to avoid confusion or incidents in the provision of the service, and the delivery of the products purchased.
The products to be purchased must be selected and added to the shopping cart by clicking on the corresponding icon.
After selecting the desired Products, in order to purchase them, the CUSTOMER must access the shopping cart, where he/she must fill in the corresponding purchase form that will appear on the screen, together with a summary identifying the selected Products, their total price, the applicable taxes and, if applicable, the applicable shipping costs.
The verification of such data shall be the sole and exclusive responsibility of the CUSTOMER. Navité shall not be liable to the CUSTOMER for any errors or inaccuracies in the order if the Products shown in the order confirmation have been shipped.
Next, the CLIENT must fill in the corresponding form with his/her data or incorporate his/her user data if he/she is already registered, and indicate the delivery address of the product. If the CLIENT should provide any false, inaccurate or incomplete information, or if Navité has sufficient reason to suspect that such information is false, inaccurate or incomplete, it reserves the right to cancel the purchase of the CLIENT. In such case, Navité will inform the CLIENT, and will proceed to refund the amounts paid, discounting the expenses generated by the transaction, through the same means by which the payment was made, within fourteen (14) days following such communication.
Once the purchase form is completed, the CLIENT must accept the present Conditions, once accepted, select the desired payment method and confirm the order. Depending on the payment method selected, the CLIENT may be redirected to an on-line payment platform where he/she can finalize the purchase through any of the accepted payment systems.
Once the transaction is confirmed, the CUSTOMER will receive a communication by e-mail with the information of his/her order as well as the corresponding invoice. Non-receipt of this message may be due to a temporary problem in network communications or a typing error in the e-mail address provided. In both cases, it is advisable to contact customer service at info@navite.es.

9. FORMS OF PAYMENT AND SECURITY
Navité accepts orders around the clock, 24 hours a day, every day of the week.
Navité accepts payments through the STRIPE platform to guarantee maximum security in payments. When viewing the symbols on this platform, the Client may consider that his transaction is 100% protected. If our security department suspects any anomaly or fraud, Navité reserves the right to cancel the transaction for security reasons.
Navité offers the Client two methods of payment:
CREDIT/DEBIT CARD PAYMENT
If the Customer chooses to pay by credit card, the Customer’s order will be charged through Stripe’s payment gateway. Stripe encrypts your bank details when they are transmitted over the Internet. For security reasons, it is our obligation to verify all orders paid by credit card. Stripe accepts Visa, American Express and MasterCard cards registered in the Verified by Visa secure payment system. If your payment is declined, you can contact customer service at info@navite.es so we can help you finalize your order.
In case the purchase has been made by a final consumer or a company, the corresponding invoice will be issued. Please send your request via e-mail to info@navite.es.
Navité reserves the right to withhold any order for security reasons, as well as to temporarily deny access to the Products purchased. The affected CUSTOMERS will be informed. Likewise, Navité reserves the right to cancel an order if it is considered that the data provided by the CUSTOMER cannot be verified.
Navité will not be responsible for delays in the delivery of orders resulting from the lack of authorization by the payment system.
10. DELIVERIES AND SHIPMENTS
HOW DO WE DO IT?
At Navité we work with shipments of varying weight and size, which means that each package has different characteristics. We make it a priority to make the best possible packaging to ensure that you receive your order in optimal conditions.
All delicate products, as a general rule, are shipped in a custom-made wooden box, with the necessary interior protections to prevent movement, and, if the weight requires it, they are also shipped palletized.
We do our best to deliver it to the courier company the day after the order is placed (for particularly bulky and/or palletized shipments, preparation and pick-up times may be modified).
HOW MUCH DOES IT COST?
All shipments within the Peninsula are free of charge. For all other destinations, write to us and we will give you the best possible option.
WHEN DO YOU DO IT?
Shipments are made Monday through Friday. Orders placed between Friday night and Sunday will be shipped between Monday-Tuesday of the following week. We do not ship on holidays and non-working days.
WHAT WILL I RECEIVE?
Depending on the product you buy, you will receive one type of packaging or another, but what you can be sure of is that it will be a professional packaging prepared for you to receive the goods in perfect condition.
In most cases, you will receive your order in a wooden box, protected with expanded polystyrene, foam, bubble wrap, recycled kraft paper, etc. but always super protected .
WHAT IF…?
1. Orders are shipped via courier/transportation company. If a shipment has been delivered, but is not in your hands, the responsibility is yours. So please check if a neighbor signed for you, or is holding the package for you.
2. If you refuse to accept a delivery, you are responsible for the original shipping charges and the cost of returning the package to our headquarters. This amount will be deducted from your merchandise refund.

11. CANCELLATION OF ORDERS
The CUSTOMER may cancel without charge and without providing any reason, the order of any product, as long as it has not been shipped. Please note that orders are usually shipped the day after purchase.

12. WITHDRAWAL,RETURNS AND EXCHANGES
For Navité, customer satisfaction is the key to success. Therefore, our main interest is to make your shopping an unforgettable experience.
You have a period of 14 calendar days from the date of receipt of the order to execute the right of withdrawal, return or exchange.
If a product arrives defective or damaged, you must make a claim for the products within 24 hours of receipt of the order. As these are unique products in many cases, it will not be possible to exchange for the same product, and the damaged product must always be returned to our warehouses at no cost to the customer.
If a product is defective and the product is returned to us for further testing, but finally the product is not defective according to the subsequent analysis, the costs of returning the product to our warehouses and its subsequent shipment to the customer’s home shall be borne by the customer.
In this sense, in order to exercise the right of withdrawal, return or exchange of the purchased product, the following conditions must be met:

WITHDRAWAL
The CUSTOMER, in relation to those orders that do not contain fresh and/or perishable products that by their own characteristics may deteriorate or expire quickly, products made according to the specifications of the CUSTOMER or clearly personalized and/or sealed goods that are not suitable to be returned for reasons of health protection or hygiene and that have been unsealed after delivery, has the right to withdraw from this contract within a period of 14 calendar days without the need for justification.
The withdrawal period shall expire 14 calendar days from the day on which the CUSTOMER or a third party indicated by him, other than the carrier, acquired material possession of the product.
To exercise the right of withdrawal, the CUSTOMER must notify us of his decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by post, telephone or e-mail), either by sending it to the e-mail address info@navite.esmailto:info@navite.es or by calling +34674831720.
You may use the model withdrawal form that you can download here, although its use is not mandatory.
In order to meet the withdrawal deadline, it is sufficient that the communication concerning your exercise of this right is sent before the expiration of the withdrawal period.
Consequences of withdrawal:
In the event of withdrawal by the CUSTOMER, we will refund all payments received for the purchase, including delivery charges (with the exception of return shipping costs resulting from the CUSTOMER’s choice of a delivery method other than the least expensive ordinary delivery method offered by us) without undue delay and, in any event, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to make such reimbursement using the same means of payment used by the CUSTOMER for the initial transaction, unless the CUSTOMER has expressly provided otherwise; in any case, the CUSTOMER will not incur any costs as a result of the reimbursement.
Notwithstanding the foregoing, we may withhold reimbursement until we have received the Products, or until the CUSTOMER has provided proof of return of the Products, whichever condition is met first.
The CLIENT shall return or deliver the goods directly to us at Navité, Calle Anglès nº14, 17412 Maçanet de la Selva (Mas Altaba), Spain, without any undue delay and, in any case, no later than 14 calendar days from the date on which he/she communicates his/her decision to withdraw from the contract. The deadline shall be deemed to have been met if you return the goods before the deadline has expired.
The CUSTOMER shall bear the direct cost of returning the Product, i.e. the cost of returning the Product to our warehouses.
The CUSTOMER shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the Products purchased.
RETURN
If the purchased product has any manufacturing or quality defect (taking into account that these are imperfect objects due to the passage of time), or in case of loss of products by the courier, the CUSTOMER may request its return, within 14 calendar days after the acquisition of the material possession of the product. In such a case we will take care of picking up the defective product.
Products on sale, on promotion and/or discounted products do not accept exchanges or returns.

14. INTELLECTUAL AND INDUSTRIAL PROPERTY
Navité guarantees to the CLIENT to be the holder of the rights of intellectual and industrial property on the sold Products and/or in its case, to have the necessary authorization for the commercialization of the same ones through its web page.
The CLIENT recognizes and accepts that the Products, as well as their contents, wrappings, materials, etc., are subject to Intellectual and Industrial Property rights, whose ownership corresponds to Navité and/or third parties.
The acquisition of the Products and the navigation by the web page of Navité in no case will be understood as a resignation, transmission, license or total or partial cession to the CLIENT of the rights of intellectual and industrial property owned by Navité or, in its case, of the third party to which they correspond. The CLIENT will not be able in any case to alter, to exploit, to reproduce, to distribute or to communicate publicly the Web, its contents or the products acquired through the same one, without the previous and express authorization specifically granted, to such an effect, by Navité or, in its case, by the third party to which they correspond.
15. MODIFICATION OF CONDITIONS
Navité reserves the right to modify this agreement, when it deems appropriate or in order to adapt such texts to legislative or technological changes or to its contractual relationship with third parties. The CUSTOMER shall be duly informed of such modifications.
16. PARTIAL NULLITY
Should any part of these terms and conditions be unlawful and therefore invalid, this shall not affect the other provisions which are in accordance with the law. The parties undertake to renegotiate those parts of the terms and conditions that are null and void and to incorporate them into the rest of the terms and conditions.
17. EXCLUSION OF WARRANTIES AND LIABILITY
Navité will not be responsible for the delays or failures that took place in the access, functioning and operativity of the Web, or in its Products, as well as neither of the interruptions, suspensions or the bad operation of the same one for causes foreign to Navité or when they had their origin in breakdowns produced by natural catastrophes or situations of major force, or of extreme urgency, such as strikes, attacks or computer intrusions (computer viruses that affect the devices of the users) or any other situation of major force or fortuitous cause.
Navité reserves the right to interrupt the access to its web page www.navite.es, as well as the provision of any or all the contents that are lent through the same ones in any moment and without previous warning, either for technical reasons, of security, control, maintenance or for any type of failure in telecommunication networks or of electrical supply.
Navité will not be responsible in case of failures in the service, malfunction or any other cause that does not have direct control over them or that has its origin in fraudulent or negligent actions of the user or by causes of force majeure or attributable to third parties.
Navité does not have any responsibility on information, data, images of any type and links published in its Web coming from third parties not assuming any guarantee on the veracity and accuracy of the information that are put at the disposal of the users or that are facilitated by the own users.
Navité shall not be liable for any damage caused by failure to comply with the instructions regarding the maintenance of the products purchased by the CUSTOMER.
Likewise, Navité shall not assume any liability for direct or indirect damages, consequential damages and/or loss of profits.
The CUSTOMER shall hold harmless Navité from any liability that may arise from third party claims about infringement of rights that may result from its performance.
18. CONFLICT RESOLUTION
These General Conditions are governed by applicable Spanish law.
The intervening parties undertake to resolve amicably any differences that may arise in relation to these conditions. In the event that an amicable solution is not possible, and a legal dispute arises, both parties agree, provided that the user has the status of “consumer or user” as defined by Spanish law, to submit to the Courts and Tribunals of the User’s domicile. In all other cases, and unless the applicable law mandatorily provides otherwise, the parties agree to submit to the Courts and Tribunals of Girona, expressly waiving any other jurisdiction.
We also inform you that you have the right to request an out-of-court resolution of consumer disputes through the online dispute resolution platform developed by the European Commission, accessible through the Internet address http://ec.europa.eu/consumers/odr/.
